Building a fixed seat against a balustrade?

Hi there,

I'm sure the code on balustrades is min 1000mm from all fixed surfaces. I have been asked to construct a series of seats and decorative planters which will step up to the balustrade thereby reducing that distance. The first thing I thought was how high is the drop cos somebody will end up over the edge.

I have pushed it back to the designer to check regs and redesign but I'm worried they will just hand it to another unsuspecting tradie.
